377. The Disputed Child Must Return to the Father




 

Last October, a child from Cittadella in Treviso, Italy  was removed from school and forcibly dragged away by his father with the help of the police and transferred to, let’s call it, " a protected house" as if he did not have a house already! In March, the Supreme Court entrusted the child to his mother. Now the Court of Appeal of Brescia gives final custody to the father.

After reading  the following article from the "Giornale.it" (see link below) I agreed with the first comment after which others followed. So as not to cause problems, I am publishing only my own. I am also adding links in order to give the background to the story in English.

But do you realize what's going on in the head of this child? The damages present and future that are being caused? I do not know whose fault it was, but I think if now, after what has already passed, if he had been left with his mother with all the rights of the father to see him and take turns to be with him, would have been be the best thing. I'm a grandfather so I can relate to this drama, "and if it happened to my granddaughter," it would be staggering. Therefore I believe that the resentment of the father to get to have custody, is just selfishness, and since he is a lawyer, wants to see how good he is at getting his own way. But is it right for the child?????

I fully agree with what occhiotv wrote... certainly in Italy there is no justice, and this is a case to be brought before a court outside of Italy, as far as the EU or even the UN Human Rights for children because that child’s rights has not been at all protected.

Too easy to say that the mother would not let the child see his father- and what if it was the child who did not want to see the father? This child has no say in the matter, he  has merely been torn away from his world with an insensible violence last October ... and this, all for the good of the child? It 's a case to be brought before a worldwide court for the rights of children.

For those gentlemen to which my way of thinking is scary as they so claim, let me say it shows that they love violence against children, because to snatch a child from his world, his friends, his companions, his grandparents, uncles, mom, toys, home, school, dogs or cats by force and drag him along the pavement of a street and put in an institution... this is not violence?? It 's a case to be put before the court for the protection of children at UNICEF where “caste” does not count and the judges know what they are doing.

Even if, and it is a big if, that PAS (illness of hatred against parent) exists, this does not justify the violence that the child has suffered and continues to suffer, since his conditions are imposed on him  with force and not by choice. No parent has the right to impose their presence forcibly. A parent, PAS or no PAS must earn the love and esteem of the child, not subject the child to their presence by force, causing discomfort, because in the end a child may very well interpret this act for what it is, violence. The child has the right to refuse anyone he doesn’t want. It cannot be imposed upon a child to love on command, No parent has the right to do this. Unfortunately, the violence continues because the right of the child is still trampled on since his wishes are not taken into consideration. Someone should protect the rights of the child in front of the Court for the protection of children’s rights at UNICEF, so perhaps this child will then no longer have to suffer further unwanted impositions upon him.
