344. Marò: “Fake Documents from India”

I know how distressing it is for Indian people not to be able to have decent politicians and a government who will act in favour of the people instead of themselves. I know how painful it is for Indian people to gain equality and justice. I know how difficult it is for many Indian people to survive in a decent manner when authorities treat them as mats under their feet. I know because at the moment this is how the Indian authorities are treating, in the same way, another nation- Italy.

My experience of Indian people is an amazing one, otherwise I would not have gone to India, I would not have worked with Indians, I would not have written their history and I would not have started “The True India Blog” if I did not feel passionate about India and Indian people.

However, since the Indian authorities have captured, under false pretences, two Italian Marò, specialized sailors who are there to protect other ships, including Indian ones, from the onslaught of pirates, have detained them, accused them of murder which carries a capital punishment sentence and refuses to return them to Italy, I am much disillusioned with those who are in Authority in India.

We all know that the grass is always greener on the other side and so Indian fishermen are often found floating outside Indian territory into the international waters of the Arabian Sea where the chances of catching better fish are greater.

However, that is a dangerous move because, and the Indian authorities, in particular that of Kochi in Kerala, are only too well aware, that international ships, including those of India, have been repeatedly attacked by pirates and held for ransom.  Hence when you get an international military body set up to safeguard those ships  in those waters from piracy, it is inevitable that if you are fishing in those areas you place yourself at risk automatically, especially if you don’t identify yourself as happened in this case.

As it turned out, the fishermen were not pirates but normal fishermen and the families have been  compensated by the Italian government, though, let us remember, the Italian government was not obliged to do so since the fishermen were out of bounds, and the sailors were doing their job, but the offer of compensation only goes to show the good faith and desire to maintain peaceful relationships with India. But above all it is a way to show that Italian military personnel are not trained to be ferocious killers, but merely carrying out their peace keeping mission duties.  Let us also remember if the fishermen had identified themselves, they would still be alive today.

In thanks to all this the Indian government has taken the said nation, Italy for a ride by producing a fake report which is the basis of the accusation against the two sailors, as Italian M.P. Francesco Storace claims.  The document being the expert court ballistic findings on the bullets that would incriminate the two sailors, is according to a famous court expert, a counterfeit with obvious alterations, deletions, overwrites, text undercurrent. A report different from the original and above all the conclusions of that, which could be quite different from the original presented to the court. *

It is difficult for an Indian to gain justice in India, unless it is politically or financially worthwhile, so one can imagine how much more so it would be for a foreigner, especially an Italian since it would go against the most powerful woman in India, Sonia Gandhi.  It was necessary therefore to stipulate an official agreement with India, as reported herewith:

“On October 25, the Italian Senate approved a definitive  agreement   signed between the Italian government and the Indian that allows prisoners to both countries (18 in Italian India, 108 Indian in Italy) to serve his prison sentence in their own country. Ratification described as a "parachute" for the two sailors of which, however, to date, on the Indian press there is not a trace.” **” **

However, the idea of a criminal sentence should not even be considered. “

“According to Italian law and its extraterritorial protocols, in accordance with UN resolutions governing the international fight against piracy, the sailors aboard the Enrica Lexie must be considered military personnel serving on the Italian territory - the tanker struck the Italian flag - and should therefore enjoy immunity from legal process in respect of other States.”***

“ The Indian law says instead that any crime committed against a citizen of India on an Indian ship - like St. Antony - must be judged in Indian territory, even if the accused had beenfound in international waters.” ***

It obviously was not murder, no one intended to kill the two Indian fishermen, they were mistakenly killed by sailors who were only doing their job, safeguarding others from pirates. Allowing for this tragic mistake, the Italian government have ensured that the welfare of the two fishermen families have been secured and the sons will be ensured an education and future they would not otherwise have had.

Please sign the petition to the Italian Ministry of Foreign Affairs to ask the Indian authorities for the return of the Italian sailors to their country, Italy.

I ask for solidarity from all people in Europe and other continents where democracy exists, for this is also a question of democracy. Should this be signed by a person from India, I and the Italian people will appreciate and treasure your act of good will and friendship.
